Failing a Critical Test of Leadership

Yesterday the Democratic "led" US Senate voted to confirm as United States Attorney General a man who, even after years of heated public debate could not (or would not) answer the question, "Is waterboarding torture; and, therefore, unconstitutional?" Judge Michael Mukasey, in addition to being pathetically ignorant (or politically calculating) on this issue is also on record as suggesting that there might be times when the president might be above the law. Armed with this knowledge, California Senator Diane Feinstein and New York Senator Chuck Schumer crossed party lines and voted to move Mukasey out of the Senate Judiciary Committee and on to the floor of the entire Senate for a confirmation vote. But it is not Schumer or Feinstein that should be feeling your heat today. Feinstein and Schumer, while coming down on the wrong side of the vote, at least took a stand and cast their vote. No, today we are left to wonder about four US Senators who would ask for our votes to allow them to lead our country at a time when we find ourselves debating whether or not it is part of our American values system to torture persons in our custody or whether we will continue down a path toward a codified "Unitary Executive."

When the final vote for confirmation was tallied, there were seven senators who did not cast a vote: Republicans, Alexander, Cornyn, and McCain and Democrats, Biden, Clinton, Dodd, and Obama. As I look at that list I see five would-be Presidents of the United States. This is outrageous!


I am not going to bother talking about John McCain; he was never an option in my voting plans. The four Democrats on the other hand have, in my opinion, failed a fundamental test of leadership. For those who would suggest that Mukasey was going to be confirmed whether those senators voted or not I offer this: As we have been told so many times since the Democrats were afforded the majority this year, it only takes 41 votes to sustain a filibuster. The final vote to confirm was 53 Aye, 40 Nay, and 7 Not Voting. Do the math. But wait! Do we know how the four senators would have voted? Could their voice in opposition on the floor of the Senate have made a difference with their fellow senators? We will never know - they were not there to lead.


Today Governor Bill Richardson released the following statement:

" "It is shocking that four U.S. Senators running for the Democratic Presidential nomination failed to show up and vote against Judge Mukasey or speak against him during the debate to persuade their fellow Senators that torture is a no-compromise issue.

"Judge Mukasey disqualified himself by refusing to acknowledge what the world has known for centuries: that waterboarding is torture and torture of any kind violates U.S. and international law. Alarmingly, Judge Mukasey already has shown a startling willingness to allow politics to influence his opinion regarding one of the most basic American principles -- human rights.

"The Attorney General is responsible for steadfastly defending the Constitution and implementing the laws of the land, without exception or equivocation. What should have been an easy question to answer-- waterboarding is torture, and torture is illegal-- was not easy for Judge Mukasey, who chose instead to dodge. His actions speak volumes. His answer was unacceptable, and he is unacceptable as the Attorney General of the United States. The Senate could have rejected this nomination with a filibuster. By showing up and speaking out, Senators Biden, Clinton, Dodd, and Obama might well have stopped his confirmation. Instead, they chose to sit on the sidelines and watch history pass them by.

"Last night, we witnessed a devastating failure of leadership in the fight to take back America, enforce the Constitution, and restore the principles on which this nation was founded.

"This is not what our country needs in its next President.

"Let me be clear: As President, I will ensure that any form of torture, including waterboarding, will never be used. Furthermore, I will direct the Department of Justice to vigorously investigate and prosecute any individual responsible for the use of torture. No one is above the law. No one."


I agree with him.

   Bill Richardson is far and a way the most qualified candidate for President from either side. He has a hard road ahead because competency doesn't equate to funding.
  I plan to sign for Richardson at my causcus February 9th, how many of you will do the same?
  Before my Jean died last May, she contributed the maximum individual pre nomination amount to his campaign. I just wish she'd had a chance to actually meet the man!

Absolutely unbelievable.

And I get criticized for being a useful idiot.

As I've speculated elsewhere, the national Democrats have moved as far left as they're ever likely to go.

It's hard not to suspect, now that they're about to win the White House, Dems are only too happy with Bush's accumulation and consolidation of powers onto the imperial presidency.

There was an article about that relentless trend, from Nixon up through now, in a recent Atlantic Monthly (or was it Harpers?).

Sad.

in Iowa. When the Republicans sell us out and so forth, what do we do, good Iowans? TURN UP THE HEAT! When a rudderless administration sells out our elections apparatus and spits in the docket of numerous reviews, purchasing Republican-promoted apparatus to run our elections, WHAT SHOULD WE DO?

Ummm... turn up the heat? Oooerrr... wait what does Larry Phillips think Ron Sims might say to Dow Constantine? Does anybody know?
