Ron Sims: Diebold Voting Machines "Hacker Proof"

Ron Sims stated that our Premier Election Systems (nee Diebold) ballot counting machines will be "hacker proof". Sims made this statement during his regular segment on KUOW's "Weekday" program Thursday 12/20/07. KUOW's online archive is here (skip to 16m30s).

No computer professional thinks that computers can be hack proof. But Ron Sims, a politician, thinks otherwise. This is a serious problem. Like denying evolution or insisting Iraq had WMDs.

Anyone who thinks computers can be hacker proof is not qualified to defend and safeguard the integrity of our elections.

Below is my transcript of the relevant exchange. Followed by some quick fact checking.

Steve Scher: Here we go, Gerald writes "Given the questions in the, there were a number of studies that came out about voting machines..."

Ron Sims: Yea...

SS: "And the problems with voting machines..." And I think it was, ah, California, that has, ah, held back on accrediting their voting machines

RS: Yea...

SS: "Given the questions," he writes, "about voting machines, do you still support allowing Diebold to control our elections?" is how he puts it.

RS: Well, the, umm, remember there's two different machines that we have in play. Ehh, um, the counting machines, um, as well as the machines that are at polling sites. We're talking about the counting machines.

We looked at the Secretary of State's work in California and the most recent work being done by another Secretary of State, and the upgrades, the patches, that Diebold is putting in place, are those that were demanded for certification by the State of California. And so when we get those, we will have what we call, the, the systems that California will be approving will the ones that we are as well.

 And, um, they're going to be hack proof.

SS: [pause] Promise?

RS: That's what everybody who's reviewed it, ah, has said. Um, we, um, believe it will be, um, hacker proof.

Fact Checking

Certification

Election equipment used to count votes are "certified", not accredited. Equipment must first be federally certified. This is incompetently done by the Election Assistance Commission. Then each state certifies gear for their own elections.

Decertification

California Secretary of State Debra Bowen decertified and conditionally recertified all of the voting equipment used in that state. This was done in response to the findings of their "Top to Bottom Review". Here are the conclusions about Diebold:

The even shorter summary: California's researchers confirmed that all of Diebold's hardware and software is irredeemably unreliable and insecure.

This conclusion agrees with every independent analysis conducted to date.

Ohio Secretary of State Jennifer Brunner just released their review: EVEREST Voting System Review: VOTING SYSTEMS VULNERABLE.

Florida, Colorado, and other states have done similar work. Maryland, New Mexico, and others have already abandoned the Diebold touchscreens and are working for better ballot scanners.

Etc, etc.

Three Types of Machines

Ron Sims stated "remember there's two different machines that we have in play". There are three different machines "in play", each with its own set of problem. This misinformation is another attempt to obfuscate and redirect. Similar to Dwight "Diebold! Diebold! Diebold!" Pelz's reasoning that since our existing equipment is pretty good, we have no choice but to buy all new untested, uncertified gear.

In King County...

#1 - We currently use the Diebold AccuVote OS ballot optical scanner for both the precinct-based and central count. These machines have serious problems, most famously The "Hursti Hack", where memory cards were modified to change the vote count. Undetectably.

#2 - We also use the Diebold AccuVote TSx computerized voting machine. This is the infamous "accessible" touchscreen. These machines are irredeemably flawed and should not be used for any reason in any capacity.

#3 - We are planning to use Premier/Diebold's new DRS PS900 iM2 highspeed ballot image scanner. Contrary to what Sims stated on KUOW, California has not reviewed or certified the DRS unit. King County will be the first customer in North America. No one in North America has inspected this machine. It's not even federally certified yet, for whatever that's worth.

NOTE: Despite its problems, the most reliable way to count the votes today is to use the Diebold AccuVote OS optical ballot scanner at the poll sites. (TODO: Need link to study here.) This is a case of "the Devil that you know." All other available options are worse. Sad, but true. Fortunately, some of the AccuVote OS's biggest problems can be mitigated with physical security. The Reckless Plan

Quick review...

Executive Ron Sims' reckless plan to overhaul everything just before the Presidential election (general election November 2008) includes:

  • Being the first customer to use the DRS PS900 iM2
  • close the existing poll sites
  • add new ballot drop off boxes (expensive)
  • add new Regional Voting Centers (very expensive)
  • eliminate paper ballots at the RVCs, only Diebold AccuVote TSx touchscreens will be available for an estimated 42,000 voters
  • replace our paper poll books with electronic poll books (which have reliability problems, causing a few election meltdowns)
  • use Election Trust's (nee VoteHere) Mail-in Ballot Tracker, which is expensive and doesn't actually work

Etc, etc.

I'm just repeating myself here. How many times did the little boy point out the emperor had no clothes?

  But, I have to say that I think a system based on real computers (Mainframe running z/OS) with secure encryted network (SSL and/or VPN) and very dumb machines at the poll sites could be "unhackable". Possibly something with open using Linux (or zLinux) might make the grade also.
   Of course, since real computers have been "dying" for the last 25 years, this will not likely happen.

Clearly it is unconstitutional to privatize the vote counting system. Ron Sims is apparently no friend or defender of Democracy.

We in fact did have an audit in 2004 that was the best possible--two different machine counts (one central, one poll-based plus central) and a complete hand count which were within 0.1% of each other.  That's why we ought to stick with it and not introduce an untested system in a critical election year.

What we should have are REQUIRED statistically valid hand count audits.  This is more important than open source software or the hackability issue.  

We check our lab scales every single day with a set of standard weights--a far more useful approach than just having schematics of the innards of the scale.  It does not make the slightest difference that there have only been a couple of failures in 15 years--we have to test them anyway.  This is because it is important that data about pollutants and changes in industrial processes be accurate.

I just can't figure out the utter idiocy of people who don't think that election integrity is not equally important.  If it's  supposed to be important, please spare us the bullshit about how the system checked out before an election, or how our audit four years ago demontstated that the system worked.  You need to keep on checking it anyway, even if it works 99+% ot the time.  I'm not insulted when EPA auditors want to see all my QA/QC checks, and there is no reason why elections workers should feel that their professionalism is being impugned when the public demands similar assurances.

As computer security expert David Dill always says "It is not enough that elections be accurate; we have to KNOW that they are accurate, and we don't"

Dear Executive Sims,

As reported on a recent Washblog story, "Ron Sims: Diebold Machines 'Hacker Proof'", You stated during a recent KUOW interview with Steve Scher that the ballot counting and sorting equipment proposed for purchase for King County is "hack proof" and will be approved by the state of California.  You stated that "everybody who's reviewed" the equipment say that it's hack proof.

Mr. Sims, I am a supporter of yours.  I vote for you.  I have even doorbelled on behalf of your campaign.  I am very grateful to you for your work in King County on environmental matters.  But, with all due respect, these statements of yours about the proposed equipment are factually incorrect.  I hope you will consider clarifying these statements on KUOW.

Reverend Soaries, Former Secretary of State of the state of New Jersey; former chairman of the Federal Election Assistance Commission; and the convener of the panel of elections officials producing the 2007 Report commissioned by the King County Council, sent a special message to the King County Council stating the following:

A Message to the King County Council from Reverend DeForest Soaries, Jr.

Dear King County Council Members:

"I was pleased to convene a group of election officials to evaluate the proposition that vote-by-mail required an upgrade to the election technology used in King County. The assembled team includes people with the right background to evaluate the need for an upgrade.  To be very clear, our team was unanimous: There is no need to upgrade.

"When election officials were interviewed about the risks associated with combination of moving to vote-by-mail, moving to a new, untried, tabulation system, no one thought it was a wise choice to do all of these in the run up to a presidential election. Not one election official was comfortable with this direction.

"I urge you to heed the warning from these election officials: There is no upside, no advantage, to moving ahead with acquisition a new tabulation system and the risks are considerable."

Multiple reviews of the equipment and systems you are proposing to purchase and put into place have recommended against the purchase, warning of the serious risks
