Prison Policy Institute Democracy Toolkit

Today the Prison Policy Initiative launched the Democracy Toolkit, a set of online tools designed to help rural citizens determine if prison populations in legislative districts are diluting their right to equal representation. Despite the fact that people in prison remain legal residents of the place they lived prior to their incarceration, the Census Bureau counts people in prison as if they were willing residents of the prison location.

If used for redistricting, these Census counts of the prison populations can seriously distort county decision making. Because county district sizes tend to be relatively small, a single prison can have a significant impact. For example, if a district's population is one-half prisoners, the resident population of that district would have twice the voting power of other districts in the county.

"This groundbreaking toolkit is incredibly useful in the grassroots effort to ensure equal representation for all," says Dan Jenkins, a voting rights activist in Franklin County, New York. "County legislatures need citizen oversight, and the Democracy Toolkit offers step-by-step guidance to help activists ensure that voting rights are not diluted or distorted by the Census Bureau's mistakes."

The toolkit offers step-by-step instructions to help residents of rural communities with prisons determine whether including prisoners in the population base harms their access to government, to quantify that harm, and to advocate for a better democracy. The toolkit includes the Correctional Facility Locator, which provides a simple interface to locate prison populations in the Census. The toolkit is designed to analyze county legislatures, but can also be used for other forms of district-based government at the regional, county and local level, including city councils and school boards.

or disadvantageous, from the standpoint of the power of an individual vote, to live in a district with lots of prisoners?

I ask because of this sentence in your piece:

if a district's population is one-half prisoners, the resident population of that district would have twice the voting power of other districts in the county.

What gives that power?

It makes no sense to include prison populations in counts made to determine voting districts, as prisoners cannot vote....

It's advantageous to have a large prison in your district because it makes the real population of your district smaller. The prison population may count in the census, but they are not a part of the surrounding community. As a result, you have more access to legislators and more control over your county than you would otherwise.

But if including the prison population doubles the weight of a vote cast near the prison, it also dilutes weight of a vote cast elsewhere in the county by the same percentage. So while including the prison population might be good for some voters, it's bad for the democratic system which is based on the One Person One Vote principle.

That's why in every rural county except for one, when the public learns that prison populations are distorting their local democracy, they rise up and demand that the county legislature draw districts that do not include the prison populations. The trick is making sure that the public knows what questions to ask, hence the Toolkit.

I would expect that the largest impact in Washington State might be in the smaller cities with large prisons, like Monroe, Walla Walla, and Port Orchard, if the city councilors there are from districts rather than at-large? The impact in Walla Walla and Monroe County might also be important as well, depending on how their districts are drawn.
