King County Elections misleading the public?

Certain employees of King County Elections (KCE) are making misleading statements about why KCE will be using touch screen voting machines at the Regional Voting Centers.

I witnessed this first hand Tuesday night, at a showing of the documentary film "Commander N' Thief". The film is about how Ohio election officials rigged the 2004 presidential election (manipulating punch cards was a major factor; film did not discuss the Diebold touch screens used in 2 counties; maybe its because no one was allowed access to the machines or the software to determine if rigging also occurred there;two Ohio election officials were convicted of rigging the recount).  

Bill Huennekens, Elections Project Manager with King County Elections, attended to take questions from the audience, along with two members of the Washington Citizens for Fair Elections (WCFE).

One attendee asked why KCE is using touch screen voting machines at the regional voting centers.  Mr. H responded that HAVA requires them to use touch screens. As was pointed out by one of the WCFE members, HAVA does NOT require touch screens.  HAVA does require at least ONE "accessible voting unit" per polling location. Some AVUs are touch screen voting machines, but not all of them are. For example there is the VotePad which involves no touch sceens and no secret vote counting. It enables a disabled voter to fill in a special ballot which is then counted in an op-scan voting machine.  Another non-touch screen voting unit approved under HAVA is the Automark. It uses a touch screen interface, but then prints out a ballot which is then counted by an op-scan. This would be a good alternative to the poorly secured touch screens. However, KCE's never considered using the AutoMark.

Anyway, it may have been a slip of the tongue by Mr.H.  However, the same statement was made by KCE's public relations person, Bobbie Eagan.  I know a person who called Ron Sims office to complain about the touch screens. She was directed to KCE. There she spoke with Ms. Eagan, who told her that HAVA requires them to use touch screens.

So, either these employees are not well informed, or they are not entirely truthful. In either case, this is not a good sign.  

What I want from my election officials (and elected officials)is honest and candid responses.  I would have a great deal more respect for their decisions if they would be open and honest about them.

Hi raincity calling. Yea, that was a crazy Q&A.

For the viewing audience, Voters Unite has been fighting the HAVA disinformation campaign nationwide for some years now. Their Myth Busters literature is invaluable, thoroughly debunking the notion that anyone is required to have computerized touchscreen voting machines.

There was a short period when King Co Elections stopped claiming they were required to have the Diebold AccuVote TSx touchscreens. There are plenty of alternatives. This regression is disappointing.

The current excuses are

- none of the other systems are certified

However, this elections services is gungho to buy a completely new system which has been uncertified and untested and unused anywhere else.

- none of the other vendor's system permit counting of the ballots before election day

Alas, counting ballots before election day, which allows insiders access to early election results, is a horrible idea.

Like other jurisdictions, our elections officials have had plenty of time (years) to find a viable (accurate, reliable, compliant) alternative to the Diebold touchscreens. Hasn't happened.

Dear Mr. Huennekens and Ms. Huff,

A Washblog story reports that at a recent showing of a film about the rigging of the national 2004 elections Mr. Huennekens answered questions from the audience and, in this exchange, said that HAVA requires the use of touchscreens.  The report also says that Bobbie Eagan gave this information to a caller.  

HAVA doesn't require the use of touchscreens.  I don't understand why this incorrect information would be coming from your office.  It doesn't seem logical that Mr. Heunnekens wouldn't know that HAVA doesn't require touchscreens.  And I don't see where a misunderstanding from the audience could have come from -- as this was a simple statement that was made and there were many witnesses.  A clarification on Washblog would really help.  Comments can be left in the stories themselves.

We should be careful to distinguish the terms 'touchscreen' and 'DRE (Direct Recording Electronically)'.  The problem is the latter--it is perfectly possible to program one of these to have the screen say one thing, the tabulator say another, and a printout say yet a third thing.  The former is a much broader term, and Diebold shills are delighted when we conflate the two.

There is no technical reason why a touchscreen interface could not be used to print out a paper ballot that could be opscanned or handcounted and that looked exactly like the other ballots.  It could be checked by a separate verifier machine if desired.

Diebold refuses to make them (and the ES&S which does do this with the Automark deliberately downplays its availability) because they are intent on forcing elections departments to accept DREs.

The problem is that elections departments refuse to act like regular commercial customers who set their own specifications for what they want in instruments that they would like to purchase, and the deal is off if the specs aren't met.  Instead, they passively accept whatever crap that voting machine manufacturers offer for sale.

In contrast, when Diebold is confronted by its banking customers, who insist that their financial data belongs to them and not to Diebold, Diebold's reaction is "Yessir!  Right away, sir!"  They proudly advertise their open source software for ATMs on their website, even.
