Restoring Felon Voting Rights

Sound Politics has a brief mention of the lawsuit to restore felon voting rights here in Washington State. I care about this issue. It's not front and center, but hopefully our election integrity group will take it up soon enough.

My personal preference is the Vermont model, where everyone gets to vote regardless of incarceration. I'd settle for the Oregon model, where you don't get to vote while incarcerated but otherwise have your rights restored immediately apon release.

There are a lot of strong feelings about this topic. At Kohl-Welles' campaign kick-off June 12th, a guy in the audience asked why felons should get the right to vote. I don't have any easy answers.

It's hard to justify enfranchising the Green River Killer (Gary Ridgway) and the Unibomber (Theodore Kaczynski). That said, disenfranchising felons dispproportionately impacts minorities. Which seems silly, since most felons are convicted of drug related or non-violent offenses. Just doesn't seem fair to me.

Regardless of how one feels about voting rights for felons and ex-felons, Washington State's current system is a huge mess. Our rules are so complicated and punitive, they unintentionally disenfranchise ex-felons who should otherwise have had their rights restored. Like the people of limited means unable to get ahead of their restitution fees. Or the stacks of completed restoration forms sitting in a basket somewhere because no one knew how to handle them.

Attorney Darin Sands of Heller, Ehrman, White & Mcauliffe spoke about their lawsuit against Washington State. If anyone has some links, that'd be great.

Back in February, New York Times ran the article Dickensian Democracy, highlighting the problems with Washington State. Horsesass.org covered the article.

Locally, Justice Works! is working on the issue in conjunction with the local ACLU. Eridani, a tireless progressive, made sure we attended Justice Works! event a few months ago. Two ex-felons gave their personal stories about the efforts to get their voting rights restored. Amazing.

[Updated: Changed my example bad guys. Apparently noted psychopath and cannibal Jeffrey Dahmer was permanently disenfranchised when he was murdered by another prisoner back in November 1994. Learn something new everyday. And fixed some typos and grammar.]

Duh. It being early morning, I didn't think to a reference our group's resolution. It's basically the Oregon model. We'll have to update it to reflect recent events and whatnot.

A bunch of us submitted to various precinct caucuses. In the Dems 46 LD, it didn't survive the platform committee guantlet. In fact, none of our resolutions did. The whole process seemed sadly undemocratic. Which I guess is the whole point, right?

Automatic Restoration of Voting Rights

Whereas Washington State has the most restrictions on voting by ex-felons in the nation, worse than any other state,

Whereas ex-felons in Washington State cannot vote until after they have paid in full all restitution and fees, resulting in more than 15,000 citizens being disenfranchised every year,

Whereas hundreds of felons who have paid their debts do not get their voting rights restored due to inadvertent bureaucratic errors,

Whereas the American Correctional Association (ACA) has called for ending the practice of withholding voting rights from parolees and people who have completed their prison terms,

Whereas current laws serve no correctional purpose and can contribute to recidivism by excluding ex-felons and their families from the civic mainstream,

Whereas requiring payment of all legal financial obligations (debts) prior to voting may be deemed a poll tax,

Whereas other people with debt are allowed to vote,

Be it resolved that voting rights of ex-offenders are restored upon release from incarceration.
