Federal judge calls 3-strikes "cruel and unusual"

As seen in a DailyKos diary posted yesterday, a Ninth Circuit federal appeals court struck down a 28-years-to-life sentence imposed in a California case.  Here's the money shot from the Los Angeles Times (emphasis added):

California's three-strikes sentencing law suffered a blow Tuesday when a federal appeals court struck down as unconstitutional a 28-years-to-life sentence for a sex offender who failed to register with local police at the correct time of year.

The U.S. 9th Circuit Court of Appeals sent the case of Cecilio Gonzalez back to federal district court in Los Angeles for resentencing after finding his 2001 penalty constituted cruel and unusual punishment, which is prohibited by the 8th Amendment.

Gonzalez's harsh sentence was grossly disproportionate to his "entirely passive, harmless and technical violation of the registration law," the appeals court said.

The California Penal Code requires a sex offender to register whereabouts annually within five working days of an ex-convict's birthday. Gonzalez had registered in Los Angeles County in May 2000 and confirmed his address a year later, meeting the yearly requirement but violating the deadline of his Feb. 24 birthday.

As soon as I read the dKos diary, still on the list of Recommended Diaries over a day after it was posted, I thought about Noemie's many posts on Washington's equally (more?) draconian three-strikes law and its misapplications.  I posted a comment in dday's diary, pointing to Noemie's dKos userpage as well as to Washblog.

I have no idea whether the federal appeals court's opinion on a California case can be applied to Washington, but I'm sure it's worthwhile for anti-three-strikes activists to explore the possibilities.

Cruel and Unusual punishment it certainly is for a NON violent offender as well as someone that didnt follow the paper trail rules. ridiculous to lock someone up for life when they only failed to tell someone where they lived in a timely manner...in washington we use 3 strikes to lock up those pesky offenders that irritate us with their behaviour, not ones that are a threat and scare us...does that Judge need a new appointment?

...because it may leave us with a hazy understanding as to exactly what crimes are considered "proportional".

of course, it may be that a test is set based on whether actual physical violence against another human is involved in the underlying crimes...which would be a more easily understandable test.
