I-933 would let the foxes into the henhouse

If I-933 passes here in Washington, we could be subjected to far worse than what Oregonians are facing right now. Oregons Measure 37 is in force and costing taxpayers millions just to process the claims.

A legislative panel granted $2.7 million in emergency funds Thursday to process a surge of compensation claims under Oregon's Measure 37 property-rights initiative.

The new money will enable the state to hire 18 full-time staff to process claims and meet a Measure 37 requirement to resolve claims within six months.

Property owners have filed nearly 1,900 claims with the state, and officials expect 150 new claims per month before a December deadline, said Lane Shetterly, the director of the Department of Land Conservation and Development....

If I'm figuring right, $4 Billion is about a third of Washington States annual budget. If I-933 passes in Washington, the claims will begin pouring in and $4 Billion may start sounding like a small number. Oregon's Measure 37 has time constraints and a deadline for claims, I-933 does not.

I don't see anything in I-933 that would limit the claims. A property owner could file a claim, get paid and then sell, the new owner could then file a claim, get paid and sell, ad infinitum. The only other alternative would be a waiver of whatever regulation the property owner objected to. For every property owner who receives a waiver how many neighbors will feel the use and enjoyment of their property has been diminished.

Initiative 933 is a civil litigators wet-dream, it would unravel civilization. Land-use regulation, Building codes, zoning codes are part of how We as communities protect ourselves; without them the alternative is to wait for the harm to be done and file a law suit.

I-933 isn't about protecting property rights, it's about using buzzwords and scare tactics to sabotaging our Representative Democracy.

...citizensteve has hit on the hidden cost of this initiative - the actual administration of it. To me though, that's only the frosting on the cake. The rest of the cake is made with loss of local zoning rights, irresponsible and unchecked developement, and stripped stream and timber protections.

Simply stated, this initiative is the most dangerious initiative the environment and economy has ever faced in Washington state. Hell, this initiative is dangerious for the entire country - people from all over the country are watching how this campaign goes, and if it passes then expect more of the same everywhere else. We have to take our stand right now and put a stop to this - right here, right now.

If you haven't already checked it out, I would highly recommend looking at NoOn933.org and pledge to vote no in November.

I would also make sure that any groups you are part of (your local Dems, neighborhood groups, etc) all know about the campaign and endorse the No on 933 campaign.

I wasn't aware that there were no limits - that makes the "vote No" argument a WAY easier sell, with the obvious exception of the minimalist property "rights" nuts.  Do these people spend ALL their time looking for ways to screw the government and other citizens, or do they try to hold down jobs at the same time?

This is a funny typo -- not Citizen Steve's -- it's in the original article.  It reminds me of Bush's injuction to "raise the pie higher" -- or something like that....

This litigation and administrative cost nightmare is what Washington's Grange is warning us about.  

This is an absolutely insane insane insane law. They've gone over the edge on this one.

Thanks Steve for this article. I am volunteering on the NO on I-933 campaign in Pierce County and we are still looking for people to give any amount of their time to help us get the word out. There is still a lot of work to be done and there are still many people who do not know exactly what this initiative is about.
Just last weekend I was at a summer event for the city of Lakewood. The republican booth was loaded with initiatives that I am opposed to. No sooner had I turned my back and they were misleading my very own mother. She was all worked up about the "death tax" people's "property rights" and she had even been duped into signing an initiative for $30.00 tabs (a direct cancellation of her vote that helped pass the law Eyeman is trying to overturn). I had to jump in tell her she was not getting the truth from those signature gatherers and explain to her how they had been deceptive. She felt bad afterward that she was drawn in on emotion.
We need everyone contributing as much time as possible (be it an hour or many hours) to help us spread the word that we need to defeat this initiative. I run into people daily who either haven't heard about I-933 or they have been deceived into thinking it was a good thing.
Thanks again Steve for the article and I encourage everyone else to please do not remain on the sidelines on this one. This is not one of those things we can patch up later. If it passes...we can NOT allow it to pass. We simply must defeat it. Please do not make the mistake of thinking it will fail simply because many people care. I want to be clear volunteers are needed statewide, please visit the website to be plugged in where you are.
