A concern about House Bill 1399 in Olympia.

On page 2 of HB 1399, the following text is added to the law:

(b) For institutions of higher education and related boards, "employee" means any employee, including employees whose work has ceased in connection with the pursuit of lawful activities protected by this chapter, except:
(i) Employees covered for collective bargaining by chapters 28B.52, 41.56, and 41.76 RCW;
(ii) Confidential employees; or
(iii) Members of the governing board of each institution of higher education and related boards, all presidents, and vice-presidents; deans, directors, and chairs; and executive heads of major administrative or academic divisions.

This is another attempt to limit the collective bargaining abilities of workers.  Much like the ruling that came down from the National Labor Relations Board that said that fill-in nurse supervisors were considered 'managers', this takes rights away.

I urge everyone to call for a rejection of this bill.  It is currently in the House Commerce & Labor Committee.  Here are the members:

Alex Wood - Vice Chair (D-3)
Cary Condotta - Ranking Minority Member (R-12)
Bruce Chandler - Asst Ranking Minority Member (R-15)
Larry Crouse (R-4)
Tami Green (D-28)
Jim Moeller (D-49)
Brendan Williams (D-22)

If there is something I'm missing about why these academic leadership positions should not get collective bargaining rights, please let me know.

  I have to disagree with you here Chad. The only difference HB 1399 makes is clarifying the status of employees under (b)(iii). As an employee of higher education, I can confirm that set of employees doesn't need any collective bargaining. They're all quite well paid already.
  They are also the people on the other side of the table in must bargaining situations.

The lowest position covered by HB 1399 is department chair.  It also covers the board of directors/trustees/regents of an educational institution ... surely they can/should be excluded from an campus union.

One might argue that on a campus with a unionized faculty the prohibition on union membership for the chair would remove one specific faculty member from the union, but it is also the case that the chair has significant and real administrative/executive duties and responsibilities.  S/he is most definitely a manager by any definition, not just the bogus Bush malAdministration one.
