Adam became an original cosponsor of H.R. 2826, introduced by House Armed Services and Judiciary Committee Chairmen Ike Skelton and John Conyers, to restore habeas corpus rights for military detainees.
The Military Commissions Act of 2006 became law last year, broadening the definition of enemy combatants and barring detainees from accessing U.S. courts to challenge their detention before a judge. Adam opposed the measure when it passed the House.
H.R. 2826 would amend current law to uphold the principle of habeas corpus as applied to detainees held by the U.S. military and other government entities, allowing them to challenge their indefinite detention without trial. The bill includes an exception for detainees who are being detained in active military combat zones, such as Iraq and Afghanistan; they will continue to be barred from filing habeas petitions. Importantly, the bill also permits habeas courts to review the actions of a Military Commission established under the Military Commissions Act.
"I believe we need to aggressively try terrorists while preserving fundamental American values. The right of habeas corpus is an integral part of our judicial system and should never have been waived for military detainees. I intend to work diligently with my colleagues in the House to remedy the mistakes made by the Bush Administration and the Republican Congress on this matter," Adam stated.
I was told that Sen. Murray would vote for an amendment to the Defense Authorization bill that would restore habeas corupus. The vote is expected this week, though one never knows for sure. The amendment is expected to be introduced by Sen. Leahy. The text is not yet available.
